Welcome to Tommy’s Canine Academy LLC .These Terms of Service  govern your access to and use of our website, online courses, coaching sessions, and related services. By visiting our site, creating an account, booking a session, or purchasing a product, you agree to these Terms.

We aim for clear, kind service. These Terms explain what you can expect from us, and what we expect from you.

This is a business policy, not legal advice. Please have your counsel review.

1) Who we are & how to reach us

2) Eligibility

• You must be at least 18 to purchase or book a session.
• Our Services are for personal, lawful use only.
• You are responsible for anyone who uses your account.

3) Changes to these Terms

We may update these Terms. If we make material changes, we’ll post the new Terms and update the “Last updated” date. Your continued use of the Services after changes means you accept the new Terms.

4) Accounts & security

• Keep your login secure. Do not share your password or course materials with others.
• You are responsible for activity under your account.
• Tell us right away if you suspect unauthorized use.

5) Coaching & training content (important)

• Training advice is educational. It is not veterinary, medical, legal, or emergency advice.
• You are responsible for your dog’s safety and your own. Use common sense and proper equipment.
• If you have any health concerns about your dog, consult a licensed veterinarian.
• If there is an immediate safety risk (to people or animals), contact local emergency services or a veterinary emergency clinic. We are not an emergency service.
• Results vary by dog, history, environment, and follow‑through. We do not guarantee specific outcomes.

6) Scheduling, cancellations & no‑shows

We use Calendly for booking. Time zones are shown in your browser’s settings.

• Reschedule/Cancellation window: Please reschedule or cancel 24 hours before your appointment.
• Late cancellations/no‑shows: Sessions canceled within 24 hours or missed without notice are charged in full.
• Arriving late: We’ll do our best, but sessions end at the scheduled time.
• Package sessions: You are responsible for booking remaining sessions before they expire (expiration dates are listed at purchase or in your account).

7) Fees, payments & taxes

• We process payments through Stripe. By purchasing, you authorize us and Stripe to charge your card or payment method for all amounts due, including applicable taxes.
• Prices are shown in U.S. dollars and may change from time to time.
• If a charge is declined or disputed, we may suspend access until the balance is paid.
• You agree not to make fraudulent or abusive chargebacks. Please contact us to resolve any billing issue.

8) Refunds & credits

We want you to be happy and treated fairly. Unless a specific product page says otherwise:

• Online courses & digital downloads: 30-day money-back guarantee. Email us within 30 days of purchase with your order number for a full refund—no hoops.
• Live coaching/consults: Refunds aren’t available after a session is delivered. Cancel 24+ hours ahead for a refund or credit.
• No-shows/late cancellations (under 24 hours): Non-refundable.
• Bundles/packages: The 30-day guarantee applies to the course portion; delivered sessions follow the coaching policy above.

9) Course access & license

• When you buy a course, you receive a personal, non‑transferable, revocable license to view the content for your own household’s use.
• Do not copy, redistribute, record, or publicly share our videos, downloads, or member‑only materials.
• We may add, update, or retire course modules to improve the program.

10) User content (photos, videos, reviews)

• You may share text, photos, or videos (for example, form submissions or homework clips). You retain ownership.
• By sharing, you grant us a non‑exclusive, worldwide, royalty‑free license to use and display that content only to deliver the Services (e.g., coaching review, private feedback).
• If you give written permission for testimonials or marketing use, you grant us the right to display that content on our site and social channels until you revoke permission in writing.
• You must have the necessary rights to the content you upload, and your content must not violate anyone’s rights or the law.

11) Intellectual property

All site content, trademarks, logos, course materials, text, graphics, and software are owned by Tommy’s Canine Academy LLC or our licensors and are protected by intellectual‑property laws. Except for the limited license in Section 9, we do not grant any rights to you.

12) Community rules

Be respectful. No harassment, hate speech, illegal activity, or unsafe training methods. We may suspend or terminate access if these rules are violated.

13) Third‑party services

We use third‑party providers, including Stripe (payments) and Calendly (scheduling). Their services are governed by their own terms and privacy policies. We are not responsible for third‑party websites or services.

14) Disclaimer of warranties

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Services will be uninterrupted, error‑free, or produce any specific training result.

15) Limitation of liability

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or revenues.
• Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to us for the Service at issue in the 6 months before the claim, or $100, whichever is greater.
• We do not limit liability for gross negligence, willful misconduct, or injury where such limitation is prohibited by law.

16) Indemnification

You agree to defend, indemnify, and hold harmless Tommy’s Canine Academy LLC from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Services, or your violation of law or third‑party rights.

17) Governing law & venue (Washington, USA)

These Terms are governed by the laws of the State of Washington, without regard to conflict‑of‑law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Snohomish County, Washington for any dispute not subject to informal resolution or small‑claims court. Small‑claims court remains available to both parties.

Class actions: To the extent permitted by law, disputes must be brought individually, not as a class or representative action.

Before filing a claim, each party agrees to try to resolve the issue in good faith by emailing the other party and allowing 30 days for a response.

18) Termination

We may suspend or terminate your access if you violate these Terms or misuse the Services. You may stop using the Services at any time. Sections that by their nature should survive (e.g., payments, IP, disclaimers, limitations, indemnity, governing law) will survive termination.

19) Force majeure

We are not liable for delays or failures caused by events outside our reasonable control (for example: internet outages, platform downtime, strikes, acts of nature, or government actions).

20) Miscellaneous

• Entire agreement: These Terms, plus any product‑specific terms shown at checkout, are the entire agreement between you and us.
• Severability: If a part of these Terms is invalid, the rest remains in effect.
• No waiver: Our not enforcing a term is not a waiver.
• Assignment: You may not assign your rights without our consent. We may assign to a successor in interest.
• Headings: For convenience only.
